Entire Agreement     This agreement contains the entire understanding between Alan Castillo, Photographer and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing and signed by all parties involved.

1. Payment and Fees: Payment for photography services is due in full prior to the start of the photography session, unless otherwise agreed upon by both parties. A non-refundable booking fee of 50% of the total is required to secure a booking. Any additional fees or charges, such as travel expenses or additional prints, will be communicated to the client before the photography session and must be paid in full before the final images are delivered.
2. Copyright and Usage: All images taken by Alan Castillo, Photographer are the property of the photographer and are protected under copyright law. The client is granted a license to use the images for personal use only as agreed upon in the contract. The client may not sell, license, or distribute the images to any third party without the express written consent of Alan Castillo, Photographer.
3. Rescheduling and Cancellation: If the client needs to reschedule or cancel the photography session, they must do so at least 48 hours prior to the scheduled session. If the client fails to give sufficient notice, the client can. be liable for an additional charge plus studio fees (If aplicable) and the the booking fee can be forfeited. In the event that Alan Castillo, Photographer needs to reschedule or cancel the photography session due to unforeseen circumstances, every effort will be made to reschedule the session at a mutually convenient time.
4. Liability and Indemnification: Alan Castillo, Photographer will take every reasonable precaution to ensure the safety of clients and their property during the photography session. However, the client agrees to hold Alan Castillo, Photographer harmless in the event of any injury or damage to their person or property during the session. The client agrees to indemnify and hold Alan Castillo, Photographer harmless against any and all claims, damages, expenses, or losses arising from the use of the images taken during the photography session.
5. Inclement Weather: If the weather is torrential or unsuitable to ensure the photo session, Alan Castillo, Photographer can determine that the shoot is not possible and the session will be rescheduled for another day. upon agreement with the client.
6. Requested Coverage: Alan Castillo, Photographer will honor requested photographs but does not guarantee any specific photographs.
7. Artistic Style: Client acknowledges that has viewed examples of previous work and is satisfied with the overall style of photography that is presented. Client understands that differences in locations, subjects and lighting allow for variations in the final outcome of the Session. There is no knowing what photos will be produced from this endeavor simply because this is an event in the future. Alan Castillo, Photographer reserves the right to artistically interpret how to photograph a scene. This may mean that some shots are color and some may be black and white.
8. Governing Law and Jurisdiction: These terms and conditions are governed by the laws of the State of Colorado and any legal action arising from these terms and conditions must be brought in the courts of the State of Colorado.
